The Boyles Seek to Exclude Expert Witness Testimony

gavelMike Boyle, doing business as Surface Dynamix, and his son Christopher, have filed a motion in the U.S. Federal District Court of Oregon, asking the court to issue an order excluding the testimony of expert witnesses Justin Price and Randy Mackey for plaintiff GlasWeld in the alleged patent infringement lawsuit.

“Neither witness performed any independent analysis, physical examination of the products at issue or personal research before swearing to their opinions. Instead, both witnesses acted as channels of lawyer invention, utilizing unreliable and unsupported methodology developed solely for this litigation,” contends the Boyles in documents filed with the court.

GlasWeld filed the alleged patent infringement lawsuit against Mike Boyle in the U.S. District Court of Oregon, Eugene division, in 2012. Christopher Boyle was later added as a defendant in the case.

GlasWeld has not yet responded to the Boyles’ motion in court.
