State Bill Expands Insurance Rule Beyond Glass

A recently proposed Delaware bill appears to widen the scope of a current anti-steering law beyond auto glass.

State Senator William Bush introduced House Bill 406 on May 7. The bill proposes amending a subsection of Title 18 of the Delaware Code.

Currently, the subsection says, “No insurance company, domestic or foreign, or any agent or employee shall require that automobile glass repair or replacement work be performed by a particular facility, individual or business establishment as a condition of payment of a claim.”

With the proposed changes, the law would read: “No insurance company, domestic or foreign, or any agent or employee may require that automobile repair or replacement work be performed by a particular facility, individual, or business establishment as a condition of payment of a claim.”

According to the synopsis listed in the bill, House Bill 406 would make “technical corrections to conform the statute with the Delaware Legislative Drafting Manual.”
