AGSC Takes Position on Right-to-Repair Legislation

The Auto Glass Safety Council has issued a paper detailing the association’s position on Right-to-Repair (R2R) legislation.

“Windshields are an essential part of the vehicle’s safety system,” says AGSC president Jacques Navant. “Cameras, sensors, diagnostic networks, secured gateways, software authorizations, and OEM calibration procedures are increasingly tied to glass replacement. When AGSC-qualified shops cannot access these OEM-controlled pathways, repairs are delayed, costs rise, consumer choice narrows, and safety systems may not be properly restored. This puts the owner/operator at risk when ADAS-based safety features are no longer functional.”

“AGSC supports enforceable, secure access to repair information,” said AGSC Public Affairs Committee chair Josh Schwermer. “AGSC also supports modernizing federal motor vehicle safety programs. However, we don’t believe H.R. 7389, as introduced February 5, is adequate. It does not create substantive Right to Repair protections for today’s vehicles. It does not expressly mandate independent replacement and calibration shops have the complete access they need to repair today’s ADAS-equipped vehicle,” he added.

The Motor Vehicle Modernization Act of 2026, also known as H.R. 7389, is designed to update and modernize the motor vehicle safety programs overseen by the National Highway Traffic Safety Administration (NHTSA).

If enacted, it would give the Federal Trade Commission (FTC) enforcement authority over independent shop access to diagnostic and repair data.

AGSC urges Congress to strengthen H.R. 7389 by: (1) expressly including glass repair, replacement, diagnostics, and calibration access as “covered” motor-vehicle repair services; and (2) preventing OEMs from using cybersecurity as a pretext to deny reasonable access to safety-critical functions, according to its position paper.

“At first glance, the Right to Repair may not seem to be a big deal for the auto glass industry,” says Navant. “But not having access to calibration and repair technology and data is a huge threat to all segments of our industry.”
