The U.S. Bankruptcy Court for the District of Delaware has scheduled a hearing for December 30, during which it will review several matters, including Belron US's objection to Diamond's motion for approval of its $8.1 million settlement with former chief executive officer and number-one shareholder Ken Levine. (CLICK HERE for related story.) In addition, the court will review the debtors', now known as DG Liquidation Corp., second amended chapter 11 plan of liquidation, filed on September 22. In conjunction with the hearing, the court has set December 12 as the deadline for Plainfield, which had previously filed suit against Levine for allegedly delaying the company's bankruptcy filing in an effort to preserve $10 million he invested in the company, to file an objection to the second amended plan.
