Appeal
in Case Against State Farm and LYNX to be Heard in March 2008
A suit filed by Rich Campfield in U.S. District Court for the
District of Colorado against State Farm and its glass claims administrator,
LYNX Services, will be heard by the U.S. Court of Appeals for the
Tenth Circuit in March of 2008 in Denver, according to court documents.
Campfield, who serves as president of Ultra Bond Licensing and
Ultra Bond Windshield Repair and Replacement, originally filed the
suit on February 19, 2003, alleges that State Farm, via its third-party
administrator for glass claims, LYNX Services, interfered with its
long crack repair services. Campfield claims in court documents
that "LYNX [customer service representatives] are trained to tell
the State Farm insured that [cracks] longer than a dollar bill cannot
be repaired because the repair will not hold."
The complaint also alleged that State Farm and LYNX "have used
their market power to foreclose plaintiffs and all other repairable
crack repair competitors from the windshield repair market." The
plaintiff made these arguments under the Colorado Consumer Protection
Act.
Campfield also filed two cross-suits against State Farm and LYNX;
all three will be heard at the March hearing, which will be held
during the week of March 17-21.
